A Catholic couple in Indiana is petitioning the Supreme Court to hold the state accountable for separating their child from their home after declining to use the child's chosen name and pronouns.

Mary and Jeremy Cox, in M.C. and J.C. v. Indiana Department of Child Services, are appealing to the Supreme Court following an investigation by Indiana officials. The investigation stemmed from the Coxes' refusal to refer to their son using pronouns and a name inconsistent with his biological sex.

Represented by Becket, the Coxes argue that Indiana was permitted by state courts to remove the child from their home due to their disagreement with the child's gender identity, based on their religious beliefs.

Despite the state determining the allegations of abuse against the Coxes as unsubstantiated, it maintained that the disagreement over gender identity was distressing to their child.

Lori Windham, vice president and senior counsel at Becket, emphasized that no parent should undergo what Mary and Jeremy have experienced. She asserted that separating a child from loving parents due to religious beliefs, especially when no abuse or neglect is found, is unjust and unlawful.

In 2019, the Coxes' son disclosed identifying as a girl, but the parents, guided by their Catholic faith, refused to use pronouns and a name inconsistent with his biology. They also sought therapeutic care for their son's underlying mental health conditions, including an eating disorder.

However, in 2021, Indiana officials initiated an investigation against the Coxes for not adhering to their child's preferred gender identity. The teen was removed from their custody and placed in a "gender-affirming" home, despite the lack of substantiated abuse claims. The Coxes contended that their child's eating disorder worsened after being removed and placed in a transition-affirming environment.

The Indiana Department of Child Services declined to comment on ongoing litigation.

The Coxes expressed their distress in a press release, lamenting the state's intervention and its impact on their relationship with their son. They expressed hope that the Justices would consider their case and prevent similar ordeals for other families.

During the trial court proceedings, Indiana officials argued for placing the child in a home where they would be accepted for their gender identity. The Coxes' visitation rights were limited, preventing discussions about their religious views on human sexuality and gender identity.

Despite being deemed fit parents by the court, the removal of their child was upheld, a decision affirmed by the appeals court.

Windham highlighted the broader implications of the case, warning against the erosion of parental rights and the infringement upon religious beliefs. She urged the Supreme Court to intervene, emphasizing the potential recurrence of similar injustices if the case is not addressed.
