The law does not grant free rein to shoot at anyone who tries to cross. Use remains tied to immediate threats and the need for rapid action. Polish authorities have repeatedly said the rules apply only when force is already being used against them or the border barrier. As of 2026, public records and statements from lawmakers show no confirmed cases of migrants killed by live fire under the new provisions.

The wider background is the multi-year effort by Belarus, with Russian backing, to push large numbers of people toward the European Union’s eastern edge. Poland responded with fencing, troop deployments, restricted zones and limits on asylum claims for those who enter irregularly from that direction. The 2024 firearms adjustment sits inside that larger security package rather than standing alone as a dramatic new departure.
