BRUSSELS (DailyKenn.com) — The European Commission fined Elon Musk’s social media platform X €120 million ($140 million) on December 5, 2025 for systemic violations of the European Union’s Digital Services Act, marking the bloc’s first major penalty against the company since the landmark content-moderation law took full effect in 2023.
The move is reminiscent of book burning in the 1930s and 1940s when fascism pretended to protect readers from dangerous ideas.
The commission said X misled users with its blue-check verification system by selling badges previously reserved for notable public figures, failed to maintain a complete public archive of political advertising and repeatedly blocked independent researchers from accessing data needed to study misinformation.
In a post Thursday evening, Musk called the fine “an attack on me personally” and urged the Trump administration to impose sanctions on the EU officials responsible. The statement amplified earlier calls from Republican Sen. Ted Cruz and Vice President-elect JD Vance, who framed the penalty as an assault on American free speech and jobs.
In short, the EU's attack on Musk and X is a proxy attack on Americans and free speech world wide. Furthermore, it send a message other social media platform that, they too, will be punished if they allow free speech.
“Europe is trying to regulate an American company out of existence,” Cruz posted hours before the fine was announced.
The investigation began shortly after Musk acquired Twitter in October 2022 and rebranded it X, when sweeping changes to verification and content policies triggered complaints from regulators across the 27-nation bloc.
Under the DSA, repeated or serious violations can lead to fines of up to 6% of a company’s global annual revenue—potentially billions of dollars for X. The platform has already faced separate proceedings over alleged failures to curb illegal hate speech and disinformation.
European Commission officials defended the action, saying the rules apply equally to all large platforms operating in the EU regardless of ownership.
Musk did not indicate whether X would pay the fine or appeal. The company has 30 days to challenge the decision before the EU’s Court of Justice.
