Josephine said the teenager then threw a can at them as they walked away. It missed. The couple kept shopping, she said, not wanting more trouble. Minutes later, the employee’s parents arrived. Josephine said they crowded her husband and that one of the adults hit him in the face. He fell. “I was terrified. I don’t know what’s going on,” she told WTKR. Surveillance video later showed Atienza, wearing red, being assaulted on the store floor. Josephine said people were still kicking him after he went down and that she told them to stop, noting he had heart problems.

Norfolk police responded around 3:20 p.m. Officers found Atienza unresponsive. He was taken to a hospital and died the next day, June 8. The Virginia Office of the Chief Medical Examiner ruled the death a homicide caused by blunt head trauma.
