DailyKenn.com — Some analysts believe Dominion Voting Systems has an uphill battle in its lawsuit against activist Sidney Powell. 

Powell, it turns out, is not merely your everyday nosy neighbor lady. She is a top-tier attorney with an impressive track record of winning challenging legal battles.

"Powell is being sued by Dominion for $1.3 billion in damages after repeatedly claiming the company played a role in a far-reaching conspiracy to rid the White House of Trump by rigging voting machines," according to forbes.com

(Also sued were Rudy Giuliani and MyPillow CEO Mike Lindell. They appear to welcome the legal actions as opportunities for discovery that will lend merit to their assertions.) 

Powell appears to be making the argument that her opinions about Dominion were not statements of fact. The far-left media seized upon that argument to suggest Powell was claiming that ‘no reasonable person’ would believe her conspiracy theories.

The impression is that Powell referred to her opinions as conspiracy theories.” 

Cleveland.com reported,  A former lawyer for Donald Trump who made several false claims of voter fraud in regard to the 2020 presidential election is now arguing that “no reasonable person” would have believed her conspiracy theories.

Powell also appears to be arguing that Dominion is a “limited-purpose public figure” whose involvement in high profile elections invites scrutiny. 

According to an article published by uncoverdc.com, Limited purpose public figures can defend against defaming statements but must prove the statement was made with actual malice, can be proved “true or false,” and that people accepted the statements as fact, in light of the phrasing, context, and circumstances. Statements of fact and opinions based on statistical analysis are not the same.

Dominion is claiming that Ms. Powell’s statements cannot be regarded by a reasonable person as truthful. This seems to me to be a counterproductive claim to Dominion’s cause, as it holds such answers in its software’s data—or should. All companies keep records.

And so it appears that Dominion's boasting of it scope of involvement makes it evident that the corporation is fair game for scrutiny.

Viz, Dominion claims it operates “nearly 300” state and local elections, managing equipment that services over “40% of U.S. voters” (almost 62 million), according to unccoverdc.com.
