MIAMI (DailyKenn.com) — Three Boys Charged as Adults in Sexual Assault of Girl at Community Garden

Authorities in Miami have charged three young boys as adults in the sexual assault of a 12-year-old girl that took place last summer, with two of them ordered held without bond following court appearances.

Prosecutors announced the indictments this week after a grand jury reviewed the case, transferring the suspects from juvenile to adult court due to the severity of the allegations. The boys, identified as 12-year-old Jusiah Jones, 13-year-old Nelson Nunez and 15-year-old Xavier Tyson, face multiple felony counts stemming from the June 18, 2025, incident in the Overtown neighborhood.

According to police reports, the girl was heading home alone around 10 p.m. after visiting a friend's house when she noticed a group of four boys near the Green Haven Project, a local community garden on Northwest Second Avenue. Investigators say Nunez approached her first, grabbing her arm and pulling her toward a couch located in the garden area between two buildings.

The girl told detectives she tried to resist and scream for help, but Jones and Tyson, who was 14 at the time, allegedly restrained her by holding down her arms and legs to keep her from escaping. As she continued to yell in pain, Jones reportedly placed rocks into her mouth to muffle her cries. Police said Nunez then removed her clothing and sexually assaulted her, with the attack lasting more than 30 minutes.

A fourth boy present at the scene acted as a witness but did not take part in the assault, according to the victim's statement to authorities. She described him as standing by without intervening, and he later provided corroborating details to investigators about what he observed.

The suspects were initially taken into custody the following day on juvenile charges, but officials held off on public disclosure until the adult indictments were secured. Jones faces charges of aggravated battery and false imprisonment. Nunez is accused of sexual battery on a minor by a minor and kidnapping. Tyson has been charged with sexual battery, false imprisonment and lewd and lascivious conduct with a child.

In court hearings on February 27, a judge denied bond for Jones and Nunez, citing the violent nature of the crimes. Tyson's arraignment occurred the same day, with similar proceedings underway.

The girl's mother expressed deep distress in statements to local media, saying she felt outraged and demanded accountability for the harm inflicted on her daughter. Residents in the Overtown community have voiced shock over the allegations, with some calling for greater parental oversight and community programs to prevent such acts among youth. Police emphasized that the decision to prosecute as adults aligns with state laws for serious offenses involving minors.

The case has sparked discussions about juvenile justice in Florida, where statutes permit adult trials for certain violent crimes regardless of age.
