Something is amiss.

Legal Latino/Hispanics in America have a higher crime rate but illegal Latino/Hispanics have a lower crime rate. 

How is that possible?

I asked ChatGPT, "Do Latino/Hispanics in America commit more or less crime than the general population?"

The short answer: More; a lot more. 

"Compared to the general U.S. population," I was told, "Hispanics are incarcerated at somewhat higher rates." [Source]

Oddly, we are also told that illegal aliens, of which nearly 80 percent are Latino/Hispanic, have a significantly lower crime rate than the general population.

Maybe you can explain. If so, let me know in the comment section. Keep in mind that were focused on crimes other than being in the country illegally.

Here is what I came up with:

• Collecting reliable empirical data is challenging when the population in question is largely undocumented.

• Research has found that fear of deportation or law-enforcement contact can reduce crime reporting among undocumented immigrants. [PDF source]

• Many illegal aliens are effectively sheltered by activist courts, particularly in blue jurisdictions where most live. 

Recent data from Pew Research Center and other demographic studies show that undocumented immigrants in the U.S. are predominantly concentrated in Democratic-leaning (‘blue’) states and urban areas. 

Now for a deeper dive.

A persistent question in U.S. immigration debates is whether people living in the country illegally commit violent crimes at higher rates than citizens or legal immigrants. Those of us who support stricter immigration enforcement argue that available incarceration and prison data suggest undocumented immigrants may be disproportionately represented in some criminal justice statistics.

Advocates for this position point to analyses of federal reimbursement data from the State Criminal Alien Assistance Program, a program created in 1994 to compensate states for the cost of incarcerating certain illegal aliens. Reviews of those records in several high-immigration states have concluded that non-citizens living in the country illegally appear in prison populations at higher rates than citizens and legal residents.

One analysis of the program’s data in 10 states with large undocumented populations found incarceration rates for illegal aliens were roughly three times higher than those of citizens and lawful residents combined. In some states the difference was greater, including estimates suggesting illegal aliens were more than four times as likely to be incarcerated in Arizona and more than five times as likely in New Jersey.

Supporters of that interpretation say such disparities indicate illegal aliens may commit serious crimes at higher rates than legal residents. They also argue that national statistics are incomplete because immigration status is not consistently recorded in many arrests or prison systems.

Admittedly, reimbursement for the cost of incarcerating certain illegal aliens may be an incentive to collar more illegal aliens.

Federal crime data illustrate the difficulty of answering the question. The Bureau of Justice Statistics tracks the number of non-citizens in federal custody but does not consistently separate those in the country illegally from legal residents. State and local prisons, which hold about 90% of incarcerated people in the United States, often lack standardized systems to record immigration status.

Not everyone agrees. 

Researchers who challenge the higher-crime claim say the available numbers are incomplete or potentially misleading. Critics argue that programs such as SCAAP were designed for funding reimbursements rather than for calculating national crime rates and may reflect reporting differences between states.

Even some analysts who argue illegal aliens may be overrepresented in prison populations acknowledge the broader picture remains uncertain because the total number of illegal aliens in the country is estimated rather than precisely known.

As a result, the debate over immigration and crime continues to rely heavily on partial datasets, state-level reporting, and competing interpretations of the same figures.

Again, to assume illegal Latino/Hispanic aliens are more law abiding than Latino/Hispanic citizens is absurd.
