Prosecutors allege that around 2:30 a.m. Toledo and Roman were walking toward 24th Street when Roman fired multiple rounds as a vehicle passed. Police ShotSpotter detector technology registered shots fired and a squad car arrived at the scene.[7] According to prosecutors’ initial claims, they alleged that Toledo ran away from the officers, was chased into an alleyway,[8] turned back to the officer with a gun in his hand, and was then shot in the chest.[9] The police claimed a handgun was recovered at the scene from behind a fence.[10]
On April 15, 2021, however, the body cam footage of Toledo’s shooting was released, which showed that when the officer chased Toledo into the alleyway, the officer yelled, "Show me your fucking hands." Toledo turned toward the officer with his hands up and had no gun in his hand. With Toledo's hands in the air, the officer shoots and kills him.[1]
